Digital Purchase Terms

Agreement

This Agreement is a legal agreement between you (or the Company you represent) and Toybox Labs, INC, (“Toybox”) for the Toybox Mobile App, Toybox Web App, Toybox Printer, and Toybox Website (www.make.toys), which may be provided separately or in the form of pre-installed, embedded software on a Toybox products and which includes all associated media, printed materials and “online” or electronic documentation (the “Licensed Software”). You may need devices that meet the system and compatibility requirements for the Licensed Software, which may change from time to time. By accepting this Agreement, you are also accepting the additional terms and conditions, if any, set forth therein. By downloading the Licensed Software you agree to be bound by the terms of this Agreement. If you do not agree to the terms and conditions of this Agreement or do not have the authority warranted above, do not download or use the Licensed Software or Hardware.

In-App Purchases

In the Service, you may purchase, with “real world” money, a limited, personal, non-transferable, non-sublicensable, revocable license to use (a) “virtual currency,” including but not limited to virtual bolts, solely for use in the Service, and (b) “access to licensed content” (access to use content through the Service). You are allowed to purchase access to licensed content through the Service, and not in any other way. When you click to purchase, earn or are gifted Access to licensed Content, you only get a license to access to the content. You have no ownership in any of the Content you unlock and you can’t transfer it to someone else. The Content has no monetary value

Toybox may manage, regulate, control, modify, or eliminate Licensed Contant at any time, with or without notice. Toybox may update the pricing of Virtual Items at any time in its sole discretion, and may add new Virtual Items for additional fees. Toybox shall have no liability to you or any third party in the event that Toybox exercises any such rights.

The transfer of licensed content is prohibited except where expressly authorized in the Service. Other than as expressly authorized in the Service, you shall not sell, redeem or otherwise transfer Licensed Toys to any person or entity, including but not limited to Company, another user, or any third party.

You agree to pay all fees and applicable taxes incurred by you or anyone using a Toybox account registered to you. Toybox may revise the pricing for the goods and services offered through the Service at any time. All information that you provide in connection with a purchase or transaction or other monetary transaction interaction with the Service must be accurate, complete, and current. You agree to pay all charges incurred by users of your credit card, debit card, or other payment method used in connection with a purchase or transaction or other monetary transaction interaction with the Service at the prices in effect when such charges are incurred. You will pay any applicable taxes, if any, relating to any such purchases, transactions or other monetary transaction interactions.

Payment Processors

All financial transactions made in connection with the Service will be processed by a third party in accordance with their respective terms of use, privacy policy, and/or any applicable payment terms and conditions. We encourage you to learn about the practices of such third party. In no event will Toybox be responsible for the actions or inactions of any third party payment processor, including, but not limited to, system downtime or payment service outages.

Refund Policy

You lose the right to change your mind, cancel the order and get a refund after you access your unlocked content. In the event that Toybox suspends or terminates your use of the Service or these Terms and Conditions or you close your account voluntarily, you understand and agree that you will receive no refund or exchange of any kind, including for any unused virtual currency or other Virtual Item, any Content or data associated with your use of the Service, or for anything else.
